Welcome to the Capital Life Photo website. (Capital Life Photo is also abbreviated and known as ‘CLP’ through out this terms and conditions contract, in its shortened version name for official reference).
Following are the terms and conditions that govern your use of this site.
THESE TERMS AND CONDITIONS OF USE CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND CAPITAL LIFE PHOTO ("CLP)" "WE" OR "OUR"). PLEASE READ THIS AGREEMENT ("AGREEMENT") IN ITS ENTIRETY BEFORE YOU CONTINUE TO USE THIS WEBSITE OR DOWNLOAD ANY IMAGE.
- No Unlawful or Prohibited Use
As a condition of your use of the Capital Life Photo website, you warrant to CLP that you will not use the CLP web site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the CLP website in any manner which could damage, disable, overburden, or impair the CLP website or interfere with any other party’s use and enjoyment of the CLP website. You may not obtain or attempt to obtain any materials or information through any means not intentionally or provided for through the CLP website.
- Ownership of this Website
This website is owned and operated by Capital Life Photo. All of the content featured or displayed on this website, including, but not limited to, text, graphics, photographs, moving images, sound, illustrations and software ("Content"), is owned by CLP.
All elements of CLP website, including, but not limited to, the general design and the Content, are protected by trade dress, copyright, moral rights, trademark and other laws relating to intellectual property rights. Except as explicitly permitted under this or another agreement with CLP or one of its subsidiaries, no portion or element of this website or its Content may be copied or retransmitted via any means and this website, its Content and all related rights shall remain the exclusive property of CLP or its licensors unless otherwise expressly agreed. You shall indemnify CLP, its subsidiaries, its affiliates and licensors against any losses, expenses, costs or damages incurred by any or all of them as a result of your breach of the terms of this Agreement or your unauthorized use of the Content and related rights.
All web images, design and code remain the copyright of CLP and may be reused at any time (unless specifically requested otherwise by a client).
- Disclaimers
This website and its content are provided "as is" and CLP excludes to the fullest extent permitted by applicable law and warranty, express or implied, including, without limitation, any implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. CLP will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive and consequential damages. The functions embodied on, or in the materials of, this website are not warranted to be uninterrupted or without error. You, not CLP, assume the entire cost of all necessary services, repair or CLP uses reasonable efforts to ensure the accuracy, correctness and reliability of the Content, but we make no representations or warranties as to the Content's accuracy, correctness or reliability.
Users of this website agree that any and all disputes arising from the use of this website, or the ordering of materials from this website, shall be settled by binding arbitration. Notwithstanding the foregoing, however, CLP shall have the right to commence and prosecute any legal or equitable action or proceeding before any court of competent jurisdiction to obtain injunctive or other relief in the event that, in the opinion of CLP, such action is necessary or desirable.
No Waiver, Severability No action of CLP, other than an express written waiver or amendment, may be construed as a waiver or amendment of any of these Terms and Conditions of Use. Should any clause of these Terms and Conditions of Use be found unenforceable, wherever possible this will not affect any other clause and each will remain in full force and effect.
We reserve the right to change these Terms and Conditions of Use prices, information and available contractual license terms featured on this website without notice. These conditions set out the entire agreement between Capital Life Photo and you relating to your use of this website.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND CAPITAL LIFE PHOTO, WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION BETWEEN YOU AND CAPITAL LIFE PHOTO RELATING TO THE SUBJECT OF THIS AGREEMENT.
You agree that by using this site or images, photos or files from this site, that you are bound by this Agreement. This Agreement evidences the complete understanding of the parties (you and CLP) with respect to the subject matter hereof and may not be amended, modified or waived in whole or in part except in a writing signed by the parties. This Agreement shall be subject to and constructed according to English Law.
Capital Life Photo reserves the right to change the terms, conditions, and notices which the CLP website is offered, including but not limited to the changes associated with the use of CLP website.
- Links
There may be links to other websites from the CLP website; however, these other websites are not controlled by CLP and CLP is not responsible for any content contained on any such website or any loss suffered by you in relation to your use of such websites. You waive any and all claims against CLP regarding the inclusion of links to outside websites or your use of those websites. Additionally, parties other than CLP provide services from this website. CLP does not evaluate or warrant the offerings or services of these parties, and does not assume any liability for the actions, product, services, or content of these parties. CPL provides these links to you only as a convenience, and the inclusion of any link does not imply endorsement by CLP of the site or any association with its operators.

The information you give to us via the purchase process will be held securely and in accordance with the Data Protection Act 1998. It will only be shared with organizations that are providing Capital Life Photo services or delivering Capital Life Photo services on our behalf.
- Capital Life Photo is committed to protecting your privacy and developing technology that gives you the most and safe online experience. By using CLP website, you consent to the data practices described in this statement.
- Here is also information about your hardware and software that is automatically collected by CLP. This information can include: your ip address, browser type, domain names, access times and referring website addresses. This information is used by CLP for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Capital Life Photo website.
- Capital Life Photo encourages you to review the Privacy Statements of Web Sites you choose to link it from CLP so that you can understand how those websites collect, use and share your information. CLP is not responsible for the Privacy Statement or other content on websites outside the CLP website.
- Capital Life Photo collects and uses your personal information to operate the CLP website and deliver the services you have requested. - Capital Life Photo does not sell, rent or lease its customer list or information to third parties. CLP may, from time to time, contact you on behalf of external business partners about a particular offering, product or service that may be of interest to you. In those cases, you’re your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. In addition, CLP may share data with trusted partners to help us perform statistical analysis, send your email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to CLP, and they are required to maintain the confidentiality of your information.
- Capital Life Photo does not use or disclose sensitive personal information, such as race, age, religion or political affiliations, without your explicit consent.
- Capital Life Photo keeps track of the website pages your customers visit within CLP website, in order to determine what CLP services are most popular. This data is used to deliver customized content and advertising within CLP to customers whose behavior indicates that they are interested in a particular subject area.
- Capital Life Photo web site will disclose your personal information, without notice, only if required to do so by law or in good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with the legal process served on CLP or its website’ (b) protect and defend the rights of property of Capital Life Photo; and (c) act under exigent circumstances to protect the personal safety of users of Capital Life Photo, or the public.

- Arbitration
All disputes arising under this Agreement shall be arbitrated under UK law. The client shall pay all arbitration and court costs, reasonable legal fees and expenses, and legal interest on any award or judgment in favor of Capital Life Photo.

Copyright and Use
- All photos on this site are protected by international copyright laws.
- It is a criminal offence to make copies from them by any means under the Copyright, Designs and Patents Act 1988.
- Capital Life Photo reserves the right to place any image from commissioned photo shoot on the website for potential sale and download (unless specifically requested otherwise by a client in writing). All images remain the express copyright of CLP at all times. Any photograph may be reproduced by CLP for publication, exhibition, display, competition or other promotional purposes.
Photographic Materials: All photographic materials, including but not limited to digital images, video, negatives, transparencies, proofs, and previews, shall be the exclusive property of the Capital Life Photo.
Use of images: Images are issued to clients on a 'Royalty Free' basis. All images are Royalty-free. You don't have to pay any additional royalties on a use-by-use basis. Once you purchase a royalty-free product, you may use it multiple times for a single project without paying additional fees. (Pornographic, defamatory, libelous or otherwise unlawful use of any image is, of course, prohibited.). This applies to the invoiced company or person only. Any subsidiary, associate or sister company or organization must purchase their own images. A company or person can not pass on any image to a third party company or person for their own use. Multiple projects must be paid for on a use by use basis.
- Although Capital Life Photo offers downloaded images Royalty Free, CLP makes no claims or warranties as to the validity of the model or property releases associated with any image and such releases should be verified by you and that such usage shall be at your risk. Unless there is an explicit written statement from CLP stating otherwise, you should assume that no consent from persons or owners of property depicted in an image has been given regarding publication and that model and property releases are not available from CLP or its content providers.
Restriction on Usage of Photos: The digital photos on this site are licensed to Capital Lifer Photo. They are equipped with copyright and license information and also carry a watermark. If you receive permission from CLP to use a particular photo, you may use a copy from CLP as long as you inform us of the usage as to avoid misunderstandings (we do not appreciate and react strongly when finding our photos on other sites that use them without permission). We can also provide you with a copy of the photo, which the watermark will remain on unless otherwise agreed.
- Capital Life Photo do not offer any license in respect of use of likenesses, names or trademarks depicted in the image(s). It is your responsibility to ensure that all necessary clearances are obtained, and not that of CLP.
- You may not:

- You may not publish, reproduce, place on an electronic bulletin board, intranet or the Internet, license, sell or otherwise distribute the image(s) without a License to do so from CLP.
- You may not manipulate or adapt the image(s) so as to make it materially different to the original, without prior written permission from CLP.
- These photos may not otherwise be reproduced, distributed, cropped, resized, or otherwise altered without the written permission of CLP. No commercial use of these photos may be made in any way. All rights are reserved.
- You may not use these photos on any web page, commercial or non-commercial, for profit or non-profit, without written permission from CLP.
- You may not use the image(s) in any way that might be deemed defamatory, libelous, pornographic, obscene or immoral.
- Use images in any way that constitutes a violation of the rights of individuals such as defamation, intrusion on privacy, misappropriation of likeness, or depiction in a false light.
- Use images in any way that violates civil and criminal laws such as those regulating pornography, obscenity, fraudulent schemes, counterfeiting, espionage, and aid to illicit .
- activitiesPost any file obtained from the Website in a gallery format designed or intended to facilitate transfers of files via the Internet by individual users.
- Resell or distribute any file obtained from the Website or its associated depiction unless the image is an integrated part of the product being resold, and comprises less than 50 percent of the overall product’s importance or value.
- Reverse engineer, decompile, or disassemble any part of a file or accompanying materials except as permitted by law. You MAY alter the image file to suit your visual needs however.
- Use any part of an image as a trademark, service mark, logo, or part thereof.
- Remove any copyright or trademark information from any place in the files or accompanying materials.
- Display or post multiple images obtained from the CLP Website in a in a stand-alone or gallery format that makes it easy for people to copy, save or steal the photos.
- Pass on any images to a third party company or person without the express permission of Capital Life Photo.
You expressly agree that use of all images, files, or software distributed by CLP is at your sole risk. CLP does not warrant or guarantee that files or images on the Website are free from copyright or other intellectual property concerns.
Capital Life Photo disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. Under no circumstances shall CLP or its content providers be liable to you or any third-party for any indirect, consequential, incidental, special or punitive damages, including but not limited to lost profits and business interruption, irrespective of the type of cause of action, arising in any way from use of the Website, even if CLP is expressly advised of the possibility of such damages.
In no event shall Capital Life Photo liability exceed the fees paid for the use of the files. No oral advice or written information given by CLP, its content providers or the like, shall create a warranty; nor shall customer rely on any such information or advice. You acknowledge that this paragraph shall apply to all content, images, and services available through this Website.
- Crediting Capital Life Photo:
Finally, we ask that you mention Capital Life Photo where and when you use photos originally found on our site, whatever agreement you have with CLP and credit capitallifephoto.co.uk in this website format whenever possible.

Payment Terms
- Payment for all products and services provided by the Photographer must be made upon completion of the shoot, except for when the client has been granted credit terms. For clients given credit terms, invoices must be paid within 30 days of invoice date. Interest may be charged at 3% per month above the Bank of England base rate on invoices remaining unpaid after 30 days.
Fees and Expenses: All prices quoted to the Client apply only to the original brief given to the Photographer by the Client. The Photographer reserves the right to make additional charges for fees and expenses should the brief change before or during the photo shoot. Wherever possible, the Photographer shall endeavor to provide an indication of what these additional charges will be.
Interpretation of brief: The Client shall ensure that there is an authorized representative present at the photo shoot to view the Photographer’s interpretation of the Clients brief. In the event of no Client representation, the Photographer’s interpretation of the brief shall be deemed as correct.
Indemnity: The Client hereby indemnifies and holds Photographer harmless against any and all liabilities, claims, and expenses, including reasonable legal fees, arising from Client's use of the Photographer's work.
Re-shoots: The Client will be charged 100% fee and expenses for any re-shoot required by Client. For any re-shoot required because of an act of God or the fault of a third party, the Photographer will charge no additional fee and Client will pay all expenses. If the Photographer charges for special contingency insurance and is paid in full for the shoot, Client will not be charged for any expense covered by insurance.
Digital format: For all images/data supplied to the Client in electronic format (including but not limited to electronic mail, CD’s/DVD’s etc), The Photographer will endeavor to ensure that the data sent is not corrupt and is virus-free. The Photographer will not be held responsible for any damage, disruption and/or loss of any kind that the said media may cause to the Clients computer or data. The Client agrees to take similar steps to ensure that data sent to the Photographer is not corrupt and/or virus-free.
Miscellany: This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the United Kingdom.

Website-Photo Removal
We always try to ensure that we have obtained permission to use the photos on this website. This is not always possible at public events. If you see your photo on this website, that you feel should not be available for public viewing, then please let us know and it will be removed.
Please allow us 24-48 hours to complete your request. Usually we remove the photo well in advance of this.
To do this removal process, please email us at: enquiries@capitallifephoto.co.uk or telephone: 020 7713 0212 and we will process your request as urgently as possible. Please supply us the following information: the date the photo was taken; name of event if applicable; a description of the photo content and a photo reference number if possible.
You will be notified as soon as the photo(s) have been removed via the email address or telephone number you supply us with.
Event images are normally displayed on our web site for three months before being taken off.

Photos Not on the Website
Each event has a quota for the number of photos that can go online. As well as this, it is at our photo editor’s discretion as to which photos go online and which do not. We do not display any photos that we think could possibly ridicule a person, make them appear unflattering. Or simply it may not have been taken correctly by the photographer, because their flashgun may not have fired or it was just not a good photo to show.
Please remember to purchase your photos on the night as it is not guaranteed that they will be online.

Lost or Forgotten Username and Password

Problems Logging in to Website
- Why do I keep seeing a message saying that I am not logged in, even though I have?
If you are seeing a page that says "you are not logged in" it may be because you have "cookies" disabled in your browser. You need to enable cookies in order to stay signed in. If you are using Internet Explorer, go to the Tools menu, then Internet Options. Now select the Security tab and make sure you have security set to "medium". For Internet Explorer version 6.0 you have to explicitly allow cookies by going to Internet Properties -> Privacy.
- To enable cookies, follow the instructions below for the browser version you are using:
- Mozilla Firefox (1.0 final release and earlier)
- Go to the "Tools" menu.
Select "Options". Select the "Privacy" icon in the left panel. Check the box corresponding to "Allow sites to set cookies". Click "OK" to save changes.

- Select "Preferences" from the Edit menu.
Click on the arrow next to "Privacy & Security" in the scrolling window to expand. Under "Privacy & Security", select "Cookies." Select "Enable all cookies". Click "OK".
- Microsoft Internet Explorer 6.0+
- Select "Internet Options" from the Tools menu.
Click on the "Privacy" tab. Click the "Default" button (or manually slide the bar down to "Medium") under "Settings". Click "OK".

- Select "Internet Options" from the Tools menu.
Click on the "Security" tab. Click the "Custom Level" button. Scroll down to the "Cookies" section. To enable: Set "Allow cookies that are stored on your computer" to "Enable". Set "Allow per-session cookies" to "Enable". Click "OK".
- Microsoft Internet Explorer 4.x
- Select "Internet Options" from the View menu.
Click on the "Advanced" tab. Scroll down to find "Cookies" within the "Security" section. To enable: Select "Always accept cookies". Click "OK".

Viewing Photos Online
It depends on the nature of the Event. Usually at Capital Life Photo’s discression, or when requested by an event organizer/planner/person, to make the photos public viewing or not.
Most Corporate Events, Sporting activities, Hospitality Events, Portraiture, Weddings, Children Events Schools photography, and Weddings, usually do require a Username and Password for confidentiality.
General Public Events may not always require a Username and Password.

Terms
Payment terms for hiring a photographer are strictly 30 days from invoice date. No license to use is granted until full payment is received. Any queries must be notified in writing within seven days. UK Copyright remains with the UK corporate photographer at all times.

Ordering Prints
Print orders are completed upon receipt of order received and payment processed and confirmed. Orders are dispatched usually within 24 to 72 hours of completion. However, please allow up to 21 days for circumstances occurring beyond our control.
You will receive an email notification as soon as the order is received.
Unfortunately we cannot accept responsibility for delays due caused by postage or the carrier.
If after 21 days after the order has been acknowledged you have not received your print, please contact us. If the carrier cannot confirm delivery we will re-print and re-dispatch at no cost to the customer.
To place an order for photographic prints, you need to do the following:
Simply browse through the gallery of photographs from your event. Select the images that you want to order and add ‘checked photos’ to your shopping basket. Within the basket you can select quantity and print size for each photo. When you are happy with the contents of your shopping basket, you can choose to check out. At this point you will be asked to enter your personal details and payment information. Then you have one final chance to confirm your order. You will receive an email confirming the order and a second email when we dispatch.
When ordering a print please specify the print size required, however, please note that some print sizes may involve cropping the original image. We will always supply the print matching the longest requested axis. Payment Methods
We accept the following visa and credit cards: Euro Mastercard, Visa, Visa Electron, Maestro, and Solo.
Alternatively we can accept payment by personal cheque, bankers draft or a UK Postal order. Cheques should be made payable to Capital Life Photo.
All payments transactions are completed in GB Sterling currency.
The total order cost will be charged to your credit or debit card at the time the order is made. We accept Mastercard, Visa, Switch and Solo. All card transactions are encrypted and conducted over secure servers. Please note that we are under no obligation to accept any order placed by you and we will not be treated as having accepted any such order until you have received confirmation from us that we have done so. This confirmation will be by e-mail.

Telephone Orders
If you prefer to order your photos over the phone rather than through the website, you can call the office directly on 020 7713 0212 to do so. To process an order over the phone we require the following information:
- We accept the following visa and credit cards: Euro Mastercard, Visa, Visa Electron, Maestro, and Solo.
- Photo Reference Number. (Placed under the thumbnail photo).
- Name of event.
- Date of event / occurrence.
- The product(s) that you wish to purchase.
- The quantity of the photo(s) you wish to purchase.
- Size of prints you wish to order (state matt or gloss). If no request is received, we produce matt / luster prints for mailing out in your order.
- The full name and postal code address for delivery of the photo(s) or product.
- Full Credit or Debit Card information will be required.
Prints will then be dispatched by Royal Mail, first class, Recorded Delivery Post, only after all funds due have cleared and been accepted.
In the UK we use the first class post recorded delivery for domestic mailings and air mail for overseas. For most UK addresses, the photos will be received within three to five working days after order payment is processed. For Ireland and other European destinations delivery should be within one to three weeks. We will send you an email as soon as your prints are dispatched.
No responsibility will be accepted for failed deliveries due to the supply of incorrect information by the purchaser.

Photographs and Printing
The cropping of photos:
By default all photographs are resized to fill the photo paper. That means that some parts of the image (at the top and bottom, or left and right) may be cropped if the image is a different shape to the print. We call this setting "crop".
Printing methods and paper types:
For those that are technically minded, here is some information about our print devices and paper types.
We print on a kodak Printer using Kodak thermal ribbon technology photographic paper.
Event photos use only 'Dye Sublimation' printers that apply a clear laminate to the print that protects against UV and Ozone.
Image size:
All size are in inches and are approximate subject to trimming at our discretion.
All images are presented in the following format: 7x5ins, 6x8in, 9x6ins, 8x10in, 12x8ins, 14x11ins and 16x12ins.
Colour:
Colour photography is undertaken within the technical limitation of the process. We shall undertake to produce a good skin tone. Subsequently other colours may not reproduce accurately.
Match to original (likeness to person/colour): In accordance with the accepted practices of all professional photographers and photographic laboratories, the return of any technically acceptable photographs or prints or demands for refund or refusal to settle charges cannot be entertained on principle. No exception whatsoever can be made to this rule as we cannot be held responsible for individual tastes or expectations.
Dyes:
Because dyes used in photographic materials, like any other dyes, may change in time, prints are not warranted against any change in colour.
Permanence:
All photographs supplied by Capital Life Photo are produced to the highest standards using the best quality materials and latest processing techniques. We use professional printers to prolong the lifetime of the photographs. However, all colour photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass. CLP cannot accept any responsibility for this gradual image deterioration.
Store your prints away from extreme temperatures, high humidity and bright lights.
If displaying the print in picture frames, mount them under glass to minimize exposure to humidity, cigarette smoke and other atmospheric contaminants. Avoid placing them in direct sunlight or near sources of bright light. Although this will prolong the life of the print, prints stored in photo albums will last longer. Don’t display or store prints outdoors.
Black and white digital photos:
We use professional digital cameras which gives us the flexibility in speed but also in editing. We are therefore able to manipulate any photograph to the customer’s wishes, such as black and white prints, removal of unwanted features, and montages. It is important to stress, that we will only entertain requests for the editing of photos in terms of composition and subject matter from the client.
Branded folders for printed photos:
We can provide branded folders for the photos that we print for you. These generally take 3 to 4 weeks to manufacture. Orders need to be approved and confirmed in advance.

Delivery
After the order has been received and payment processed, the photo's are dispatched usually within one to three working days days. All orders are sent by Royal Mail, first class, Recorded Delivery Post, and so will require a signature upon receipt. You should specificy a delivery address where someone can sign for the items. Unless you otherwise advise us by email confirmation of alternative postal delivery means.
For Ireland and other European destinations delivery should be within 7 to 21 days. If your order is urgent you should consider choosing COURIER or SPECIAL delivery methods on the checkout page.
Please note, during the Christmas period, please allow up to 21 days.
Unfortunately we cannot accept responsibility for delays due caused by postage or the carrier.
No responsibility will be accepted for failed deliveries due to the supply of incorrect information by the purchaser.
You will receive an email notification as soon as the order is received.
If after 21 days, after the order has been acknowledged, you have not received your prints, please contact us. If the carrier cannot confirm delivery we will re-print and re-dispatch at no cost to the customer.
The shopping basket will show the shipping charge for your order.
International Customers:
This service is available to all, irrespective of your home country. You should note however that postage and packing costs, and delivery timescales increase for addresses outside the UK or Ireland.
Missing and Not Received Orders:
We use Royal Mail recorded delivery first class post for UK orders and Air Mail for overseas. If you have received a dispatch confirmation email from us, but your order has not yet arrived then it must have been delayed in the postal system. If you order was sent via a traceable service (if so a tracking code would have been quoted in the dispatch email) then you can go to the Royal Mail website and use their track-and-trace service. Please contact Capital Life Photo so we can also investigate.
Receiving an Incorrect Item in My Order:
A missing or incorrect item in an order is an extremely rare problem for us. However, if you have an error in the order that you have received, please contact CLP and we will remedy the situation urgently.

Returns Policy
If your order has been damaged in the post:
Please contact us quoting your order reference and details of what has been damaged. Please send to the address below with a letter containing all order details and the reason for returning the items.
We will then arrange to replace the damaged items after it has been returned back to us. Send us the receipt and we will refund your postage costs in returning damaged goods by first class mail recorded delivery.

Refund Policy
In the unlikely event that we are not able to fulfill your order then you will receive a full refund. All prints are carefully checked before dispatch. We reserve the right to request return of the print before a refund will be issued.

General Liability
Our liability for loss or damage is limited to re-photographing, or refunding any monies paid. Capital Life Photo can accept no contingent liability for any failure of any type resulting from the failure in any way of any product or service they supply.

Failure
Whilst every care is taken at every stage of the photographic process, in the event of a camera failure, operator error, material failure, or process machine failure, Success Photography can accept no responsibility for any losses however incurred as a result of any such failure beyond a full refund of the original purchase price.

Complaints
In the event of any complaint, all work subject to complaint must be returned within three days, together with appropriate invoice, reason for complaint, and contact details. Your complaint will be investigated and dealt with urgently.

Cancellation Fees / Overruns
- If a booking is cancelled by the Client within 24 hours of the starting time, the Photographer reserves the right to charge his full fee for the assignment.
- If a booking is cancelled within 48 hours of the starting time, the Photographer may charge 50% of his fee.
- If a booking is cancelled within 72 hours of the starting time, the Photographer may charge 25% of his fee.
- Any deposit paid in advance is non-refundable.
For cancellations/postponements due to weather conditions or other activities, the Photographer reserves the right to charge his full fee and expenses. In the case of a cancellation the Photographer may charge in full for any expenses incurred prior or during the commission. In the case of a shoot overrun beyond the control of the Photographer (e.g. including but not limited to the Client requesting additional photographs over and above the Client’s original brief etc), the photographer may make additional charges.

Commercial Photography
The photographer means Capital Life Photo. The client means means any person, body of persons, firm or Company with whom the Photographer enters into a contract for the sale of goods or provision of services by the Photographer.

Wedding Photography
Exclusive Photographer:
The Photographer shall be the exclusive professional photographer retained by the Client for the purpose of photographing the wedding. Family and friends of the Client are encouraged to photograph the wedding or reception as long as they do not interfere with the Photographer's duties and do not photograph poses arranged by the Photographer.
Deposit and Payment:
The Client shall make a deposit to retain the Photographer to perform the services specified herein.
Payment of the balance of the photography fee is to be on the day of the wedding date or made not later than 14 days after the wedding date. Payments for additional photographs are made after the wedding, when they are ordered. Any bank charges or fees incurred due to returned cheques will be charged to the client.
Cancellation:
If Client shall cancel the wedding date, the Client forfeits the deposit and no refund of the deposit is possible.
Should the cancelled wedding turn out to be a postponement, then, at the discretion of Concept Photographic and subject to availability, all money may be applied to the new wedding date. In this case the total fees chargeable shall be the fee which applies at the time. All deposits are non refundable. We advise all clients to purchase third party insurance cover, to cover the resulting costs due to cancellation or date change.
Weather:
Weather permitting, the wedding photographs will be taken as agreed. In the event of adverse weather conditions, the photographers will make necessary changes in the photographic session and will not be responsible for any disappointment caused by the weather. In such circumstances the photographer with the co-operation of the client will do his best to produce coverage of the wedding within the limits of the prevailing conditions.
Coverage:
The photographer cannot be held responsible for the lack of coverage caused by the bride, the groom or wedding party not being on time, or by church, Register office, or licensed place of wedding restrictions regarding photography or anyone connected with the aforementioned. The photographer does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
Copyright and Reproductions:
The Photographer shall own the copyright in all images and photographic materials created and shall have the exclusive right to make reproductions. The Photographer shall only make reproductions for the Client or for the Photographer's portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, advertising, illustration, editorial use, or for display within or on the outside of the Photographer's studio, including printed materials, media on the World Wide Web, and any current or future digital media. If the Photographer desires to make other uses, the Photographer may do so without or oral written permission of the Client.
Client's Usage:
The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than the Photographer. If Client is obtaining a print for newspaper announcement of the wedding, the Photographer authorizes the Client to reproduce the print in this manner. In such event, the Client shall request that the newspaper run a credit for the Photographer adjacent to the photograph, but shall have no liability if the newspaper refuses or omits to do so.
Failure to Perform:
If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer's illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic and digital materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client's order.
Photographer:
The Photographer may substitute another photographer to take the photographs only in the event of Photographer's illness; camera failure and back up camera equipment may fail, or in a situation where an accident may occur and the photographer is unable to continue working. In the event of such substitution, Photographer warrants that the photographer taking the photographs shall be a competent professional.
Inherent Qualities:
The Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities. Client is also aware that the Photographer is not responsible for the quality of reprints made by the client.
Photographer's Standard Price List:
The charges in this Agreement are based on the Photographer's Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
Client's Originals:
If the Client is providing original digital images, prints, negatives, or transparencies owned by the Client to the Photographer for duplication, framing, reference, or any other purpose, in the event of loss or damage the Photographer shall not be liable for any monetary amount.
Miscellany:
This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the United Kingdom.
Reshoots:
The Client will be charged 100 percent fee and expenses for any required reshoot requested by the client, and be subject to all the terms and conditions of the Assignment Photography Contract (available on request).
Terms and Conditions:
The terms and conditions of this contract supercede any and all expressed or implied terms and conditions of client’s purchase order, voucher or check (payment). Any exceptions of terms and conditions must be negotiated and stated herein as amendment(s). Client’s signature constitutes binding contract.

Sub-contracting work to other photographers
Generally No. The only exception is due to illness, equipment breakage or failure at short notice, or another act of God. We have 5 main photographers, all of whom work to the same exacting standards.
